1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Dealer Software Solutions, LLC ("Company," "we," "us," or "our") governing your use of LoyaltyLink ("Platform" or "Service").
2. Description of Service
LoyaltyLink is a real-time customer re-engagement platform that:
- Accepts VIN-based campaign uploads from dealerships
- Processes CDK/Fortellis webhooks for service events
- Matches incoming VINs against active campaigns
- Sends email notifications when matches occur
3. Eligibility
To use LoyaltyLink, you must be:
- An authorized representative of an automotive dealership
- Authorized to upload VIN data on behalf of your dealership
- Compliant with applicable data protection regulations
4. Acceptable Use
You agree to:
- Upload only VIN data you are authorized to use
- Use the platform only for legitimate dealership marketing
- Comply with Toyota LEO guidelines when using Toyota customer data
- Not attempt to reverse engineer or access other dealerships' data
5. Data Responsibilities
You are responsible for:
- Ensuring you have rights to use uploaded VIN data
- Setting appropriate campaign start and end dates
- Compliance with manufacturer data usage policies
6. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
8. Termination
Either party may terminate with 30 days notice. Upon termination, all campaign data is deleted per our standard data lifecycle.
